EU-US Privacy Shield Invalidation: What To Do Now

The European Court of Justice invalidated the EU-US Privacy Shield on 16 July 2020, following a ruling in the Schrems II case. This means that the most popular method used to transfer data outside of the EEA is no longer acceptable under GDPR. In summary, the Court ruled that the Privacy Shield does not provide equivalent protection, and so it fails to meet the adequacy requirement outlined in article 45 of Regulation (EU) 2016/679.
